The
10th amendment to the federal constitution states that anything not explicitly given to the feds to regulate shall be regulated by the states or the people. Marijuana is not in the constitution as something the feds should regulate, so states creating marijuana laws is constitutional.
The federal Drug Enforcement Agency has taken to harassing state lawmakers who are implementing state marijuana
laws:
